The Upper Macungie Zoning Hearing board granted a height variance to Richard Koze/Kay Builders on Feb. 27 concerning a proposed personal care facility. The appeal of the Wescosville-based company revolved around a property at Blue Barn Road and Oak View Drive. The builders proposed a maximum building height of 40 feet 7 inches. That exceeds the township's maximum building height of 35 feet. The request was amended to permit a building height of 38 feet, 6 inches, which was approved by the board. A 'Gas-N-Go' fuel station could be constructed on the site, as the company will come before the Upper Macungie Zoning Hearing Board next week to ask for a variance.
A new gasoline station could be coming to Fogelsville in the near future, courtesy of Weis Markets. The Sunbury-based company is scheduled to appear before the Upper Macungie Zoning Hearing Board on March 13 to ask for a variance allowing construction of a “Gas-N-Go” fuel station in conjunction with the existing Weis Market store. The property is located at northwest corner of the intersection of Route 100 and Glenlivet Drive West. It isn't the first retail space planned for the new complex. Construction on three retail establishments -- a multi-unit retail building, a bank and a restaurant -- could begin as early as this summer if submitted plans are accepted later this year by the Upper Macungie Planning Commission. The zoning appeal of T.H. Properties Inc., of Harleysville will come before the Upper Macungie Zoning Board on March 27. The company is requesting a variance for townhomes planned at 1230 Route 100 in Fogelsville. These townhouses propose a height of 39 feet, 8 inches, which exceeds the maximum building height requirement of 35 feet. Therefore, a height variance is sought by the company. T.H. Properties Inc. of Harleysville will return to the Upper Macungie Zoning Hearing Board later this year concerning a variance request for townhomes planned at 1230 Route 100 in Fogelsville. The company, according to township zoning officer Al Geosits, is changing its planned construction from townhouses to "stacked townhouses." Stacked townhouses have garages on the bottom and living space on the top two floors. These townhouses propose a height of 39 feet, 8 inches, which exceeds the maximum building height requirement of 35 feet. Therefore, a height variance is sought by the company, Geosits said. The Upper Macungie Zoning Hearing Board denied the request of a variance for Ethia Dulorie of 1603 Silo Hill Lane in Breinigsville to increase the number of children she cares for. Dulorie, and her attorney Dan O'Donnell, sought to obtain a variance Wednesday night for a Group Family Day Care facility. That would have allowed Dulorie to care for up to 12 unrelated children in her home, under state Department of Welfare regulations. Currently, Dulorie cares for six children in her home under a commercial day care facility within township zoning requirements. Dulorie has operated a commercial childcare facility in her Breinigsville home since November 2007, but said she has been looking to obtain an off-site facility for some time in order …

Elite Lawn Care, owned by Bruce Krause of 411 Grange Road, was granted special exceptions and variances for a general home occupation by the Upper Macungie Zoning Hearing Board Wednesday night, despite one objector. Krause sought a special exception for a general home occupation and variances for maximum sign area and total floor area used for the home occupation. Thomas Malitsky of 417 Grange Road and his attorney, Sam Scott, presented video evidence of Krause working in his driveway last year, which is against zoning ordinances.
