Elite Lawn Care Granted Variances

Elite Lawn Care was granted special exceptions and variances for general home occupation, despite one objector.

Elite Lawn Care, owned by Bruce Krause of 411 Grange Road, was granted special exceptions and variances for a general home occupation by the Upper Macungie Zoning Hearing Board Wednesday night, despite one objector. Krause sought a special exception for a general home occupation and variances for maximum sign area and total floor area used for the home occupation. Thomas Malitsky of 417 Grange Road and his attorney, Sam Scott, presented video evidence of Krause working in his driveway last year, which is against zoning ordinances. Krause testified that he no longer violated those ordinaces once he was made aware of them. Malitsky showed the board videos of Krause working in his driveway and property during business hours. Zoners Postpone Lawn Care Hearing

The chief complainant in the case was not in attendance, so the Upper Macungie Zoning Hearing Board moved the hearing of Elite Lawn Care to Sept. 12.

Testimony in the case of Elite Lawn Care, owned by Bruce Krause of 411 Grange Road, was postponed until Sept. 12 by the Upper Macungie Zoning Hearing Board Wednesday night. Krause is seeking a special exception for a general home occupation and variances for maximum sign area and total floor area used for the home occupation. However, the chief complainant against Krause, who is Thomas Malitsky of 417 Grange Road, was unable to attend the hearing. Malitsky presented the board with a significant written complaint, which board president Michael McCrystal called hearsay. McCrystal and the board voted 3-0 to continue the hearing until Sept. 12, when Malitsky might be able to attend and present his case against Krause. Several of Krause's …

since when is a zoning board a civil court? they could have held the hearing based on the complaint and also decide if any violations against the township ordinances exist or if relief should be granted, when they start allowing NIMBYs to run the zoning board you are going to have chaos   more ›
