Zoners Postpone Lawn Care Hearing
The chief complainant in the case was not in attendance, so the Upper Macungie Zoning Hearing Board moved the hearing of Elite Lawn Care to Sept. 12.
Testimony in the case of Elite Lawn Care, owned by Bruce Krause of 411 Grange Road, was postponed until Sept. 12 by the Wednesday night.
Krause is seeking a special exception for a general home occupation and variances for maximum sign area and total floor area used for the home occupation.
However, the chief complainant against Krause, who is Thomas Malitsky of 417 Grange Road, was unable to attend the hearing. Malitsky presented the board with a significant written complaint, which board president Michael McCrystal called hearsay.

McCrystal and the board voted 3-0 to continue the hearing until Sept. 12, when Malitsky might be able to attend and present his case against Krause.
Several of Krause's neighbor's testified to the board that the business operates without disrupting their lives.

At issue, among other things, is whether Krause violated noise ordinances, works outside specified hours of 9 p.m. to 7:30 a.m. and stores his material properly.
