Elite Lawn Care Hearing Resumes Tonight

Upper Macungie Zoners will hear testimony from neighbors who believe Elite Lawn Care is violating zoning ordinances.

Testimony in the case of Elite Lawn Care, owned by Bruce Krause of 411 Grange Road, will resume tonight at 6:30 in front of the.

Krause is seeking a special exception for a general home occupation and variances for maximum sign area and total floor area used for the home occupation.

However, the chief complainant against Krause -- Thomas Malitsky of 417 Grange Road -- was unable to attend a previous hearing. Malitsky presented the board with a significant written complaint, which board president Michael McCrystal called hearsay.

McCrystal and the board voted 3-0 to table the hearing until tonight, when Malitsky might be able to attend and present his case against Krause.

Several of Krause's neighbors testified to the board that the business operates without disrupting their lives.

At issue, among other things, is whether Krause violated noise ordinances, works outside specified hours of 9 p.m. to 7:30 a.m. and stores his material properly.
